These Terms govern your use of the iOS application "Numphabet" (the "App")
provided by Atsuki Murayama ("we", "us"). By using the App you agree
to these Terms.
The license to use the App is governed by the Apple Standard End User License Agreement.
These Terms supplement it for the game's features and server services.
1. Accounts
No registration is required. On first launch our server issues a pseudonymous
account automatically. You may optionally link the account with Sign in with
Apple to carry your record across devices.
An initial alias is generated by us. You may set an optional display name
of up to five characters. It appears on leaderboards; inappropriate names can
be reset to the generated alias through reporting and server validation.
2. Purchases
The Prism Glass theme, Candy Sky theme, and Remove Ads are separate
one-time, non-consumable purchases. Remove Ads does not include either theme.
Use "Restore purchases" with the same Apple Account to recover these products.
The Stamina Recovery Item is a consumable purchase. Each purchase grants
one item, which you may use later to add five stamina. Buying it does not
activate it. Check the App Store price shown before purchasing. There are no
subscriptions or Coin purchases.
Recovery items and paid stamina do not expire. Access and use require an
internet connection and the game account used for the purchase. Link that
account with Sign in with Apple before changing devices. Consumables are not
recovered through "Restore purchases"; deleting the game account prevents
unused items or paid stamina from being recovered on a new account.
Score Attack uses stamina. Natural stamina recovers by one every 30 minutes,
up to the normal cap of five. Recovery items add opportunities to play but do
not change scoring, time limits, or card strength within a run. Friend battles
do not consume stamina.
Purchases use Apple's App Store. Payment and refunds follow Apple's terms
and processes. Direct refund requests to Apple. Refunded purchases lose their
entitlements or unused recovery credits. Already-spent refunded credits may
be deducted from later paid stamina balances.
3. Scores and leaderboards
Scores, daily challenge completions, rewards, entitlements and
leaderboards are determined by our server. Where the device display and the
server disagree, the server's determination prevails.
This exists to prevent cheating: our server independently recomputes submitted
play records to validate them.
4. Prohibited conduct
- Unauthorized modification, decompilation or reverse engineering, except as permitted by applicable law
- Automated play, or submitting falsified scores
- Placing an excessive load on our servers
- Any unlawful act
We may delete the affected records, exclude an account from leaderboards, or
suspend access where we identify such conduct.
5. Changes, interruption and termination
We may change, interrupt or discontinue the App and its server features. We will
give notice where practical, except in urgent circumstances.
If server features stop, the parts of the game that work offline remain
playable.
6. Disclaimer and limitation of liability
The App is provided "as is". We do not warrant that it will operate without
interruption or that it is fit for a particular purpose.
To the extent permitted by law, our liability is limited to the amount you
have actually paid in respect of the App.
This limitation does not apply to loss caused by our intentional misconduct or
gross negligence. It does not restrict rights that cannot be limited under the
Consumer Contract Act or other applicable law.
7. Governing law and jurisdiction
These Terms are governed by the laws of Japan. The Sapporo District Court shall have exclusive
jurisdiction as the court of first instance for any dispute concerning the App.
8. Changes to these Terms
We will update the date above when these Terms change, and announce significant
changes in the App.
